Terms & Conditions of Online Shop Bombkarnia

The online store operating at www.bombkarnia.pl is run by Bombkarnia Małgorzata Ciszewska, NIP number 525-176-53-17, located in Warsaw at ul. Emilii Plater 47.

The online store sells goods via the Internet.

Order Fulfillment Conditions

1. Orders are accepted through the website www.bombkarnia.pl. After placing an order, the customer receives an email confirmation of its receipt by the store.
2. The acceptance of the order for fulfillment occurs:
a) at the moment the payment is recorded in the Bombkarnia store’s account – in the case of payment by bank transfer;
b) at the moment of credit card authorization – in the case of payment by credit card.
3. The order will be fulfilled provided that the goods are available in stock or with the store’s suppliers. In case some of the items included in the order are unavailable, the customer will be informed about the status of the order and will make decisions regarding its fulfillment (partial fulfillment, extending waiting time, canceling the entire order).
4. Shipment of the order will occur within a maximum of 2 business days from the moment payment for the ordered goods is received. During peak holiday periods, order fulfillment and shipping times may extend up to 5 business days.

Fulfillment Time – if the customer chooses to pay by bank transfer, electronic payments, or credit card – from the day the seller’s bank account is credited.
5. A limited number of goods are designated for promotional sales and clearance sales, and orders are fulfilled in the order they are confirmed until stocks for this form of sale are exhausted.
6. A VAT invoice can be issued for each order. The VAT invoice is issued when all goods ordered by the customer are complete and ready for shipment.
7. The customer can make changes to their order until an invoice is issued. The customer can withdraw their placed order by phone at (+48 22) 624 24 26 or via email at biuro@bombkarnia.pl. The customer cannot cancel an order that has already been shipped.

Prices of Goods

All prices are quoted in Polish zlotys and include VAT. The price listed next to each item is binding at the moment the customer places their order. The store reserves the right to change prices of goods offered, introduce new products to its online store, conduct and cancel promotional actions on its website or make changes to them. Delivery of goods occurs in a manner chosen by the customer and specified in their order.

Order Waiting Time

The waiting time for an order = fulfillment time + delivery time of the shipment. Delivery time does not equate to order fulfillment time!

Shipments are delivered by:
– Courier Company – delivery time up to 2 days
– Polish Post – priority shipment within Poland, delivery time up to 3 days
– Polish Post – priority shipment within Europe, delivery time approx. 9 days; USA – approx. 14 days.

2.The online store bombkarnia.pl is not responsible for extended delivery times of ordered products resulting from reasons beyond its control, including delays caused by Polish Post or courier companies.

3. The store is not responsible for the non-delivery of goods or delays in delivery caused by an incorrect or inaccurate address provided by the Customer.

Payment Methods

The Customer can choose the following payment methods for ordered goods:

  • bank transfer (traditional transfer) to the store’s account:

  • credit card payment – available payment methods: Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro. The entity providing online payment services for card payments is Blue Media S.A.
  • instant transfer/BLIK payment (PayNow)
  • payment via PayPal

Right of Withdrawal/Return of Goods

1. According to the Act of March 2, 2000 “On the protection of certain consumer rights and on liability for damage caused by a dangerous product,” the customer may withdraw from the goods purchased in our store without giving a reason within 14 days from the date of receipt of the shipment. This is only possible if the goods have not been used and have not been damaged in any way. The store guarantees a refund equal to the price of the goods. The seller will refund the payment using the same method of payment that the consumer used unless the consumer has expressly agreed to a different method of return that does not incur any costs for them. The money will be refunded within 14 business days via bank transfer to the account specified by the customer. The cost of returning the goods is non-refundable.
2. If the purchased goods have manufacturing defects, please return them by postal shipment or leave them at our store in Warsaw at ul. Emilii Plater 47.
3. The product will be exchanged for a full-value item, and if this is no longer possible, we will refund your money.
4. The buyer accepts that some of the offered products are handmade, which does not allow for complete repeatability of the presented offer. These differences may only slightly concern color, shape, or pattern.
5. The seller reserves the right to withdraw from fulfilling an order if the data provided by the Buyer while filling out the appropriate form on the Seller’s website is incomplete, incorrect, or untrue.
6. The seller is not responsible for the consequences of random events beyond their control that prevented or hindered order fulfillment (including fire, flood, strikes, border closures, etc.).

Returns of Defective Products (Warranty for Product Defects)

1. If the purchased product is defective, the User who is a Consumer may submit a complaint based on the Civil Code (Article 556 and following of the Act of April 23, 1964, Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended). The claim may be made based on the warranty for defects. Consumers have the right to a free repair or replacement, a price reduction, or a return of the product in case of defects. These rights apply to defects that occurred within 2 years from the date of delivery of the product(s). It is not necessary to present a receipt. Within the aforementioned period, the Consumer may, instead of the removal of the defect proposed by us, request a replacement with a defect-free item or instead of replacing the item, request removal of the defect unless bringing the item into compliance with the Agreement in the manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by us. In assessing excessive costs, consideration is given to the value of a defect-free product, the type and significance of the identified defect, and also takes into account the inconvenience that another method of satisfaction would impose on the Consumer. We will consider the complaint within 14 days.

2. To submit a complaint, the Consumer should contact us using the contact form on our website www.bombkarnia.pl or by calling: 22 620 16 66. The amount paid will be refunded in full in case of damage or defect in the product, provided that such indeed exists, including shipping costs for sending the product and shipping costs for returning this product to us. The refund will be made using the same payment method that the Consumer chose when paying for the product unless they expressly consented to another method of refund that does not incur any additional costs for the Consumer.

Right to Withdraw and Return for Orders from Abroad

If the User ordered products from outside Poland from another EU country through this website, then points 1 and 2 above apply with the stipulation that collection of an order by a courier ordered by Bombkarnia can only be carried out from the original delivery address within Poland. At the same time, we inform you that under no circumstances are we obliged to pay shipping costs to destinations other than the original delivery address or return costs from destinations outside Poland.

Final Provisions

1. The online store bombkarnia.pl is not responsible for the blocking of messages sent to the email address provided by the Customer by email server administrators, as well as for the deletion and blocking of emails by software installed on the computer used by the Customer.
2. The Bombkarnia store makes every effort to ensure that the product images presented on the website www.bombkarnia.pl are accurate. However, the products shown may differ in proportions and shades of colors depending on individual monitor settings. This cannot be a basis for complaints and returns of goods purchased from the online store bombkarnia.pl.
3. The online store bombkarnia.pl exercises due diligence to ensure that the content of the sales offer for goods corresponds as accurately as possible to reality. Due to the possibility of errors occurring during updates (e.g., prices, configurations, etc.) – any discrepancies will be corrected during the order confirmation by the online store bombkarnia.pl.
4. In matters not regulated by these Regulations, provisions of the Civil Code and provisions of the Act on special conditions for consumer sales and amendments to the Civil Code and the Act on the protection of certain consumer rights and liability for damage caused by a dangerous product shall apply.
5. All names of goods offered for sale by the online store bombkarnia.pl are used for identification purposes and may be protected and reserved under the provisions of the Industrial Property Law Act.
6. These Regulations are effective from March 5, 2022.
7. The online store bombkarnia.pl reserves the right to change these Regulations. Any changes to these sales Regulations take effect from the date they are published on the website www.bombkarnia.pl.
